An individual petitioner asked the court to direct regulation of ENDS on the model of public-place restrictions on cigarettes, rather than a ban. AVI was involved from the outset — retaining counsel to follow the case and moving to intervene — while a separate, consumer-focused writ was also considered. The government's responses in the case fed into the advisory that anticipated the national ban later enacted as PECA.

Outcome: Effectively concluded once the national ban under PECA, 2019 made the underlying question moot. AVI engaged legal counsel and tracked this litigation closely from its earliest stages, and moved to intervene formally in the proceeding.

Strengthened at the site owner’s request to reflect AVI’s actual, confirmed role: AVI’s own case records show it engaged counsel in connection with this matter from December 2017 (shortly after filing) and filed an intervention application the following year — closer involvement than “supported from a distance,” short of being the named petitioner.
